The new law will make it illegal to drive with a specific controlled drug in the body above the accepted limit for that drug.

This legislation will provide a more effective tool for dealing with the danger posed by drug drivers. It will also help reduce the wasted time, expense and effort involved for the police and the courts when prosecutions fail because of the difficulty of proving that a driver is impaired by a particular drug under current legislation.

The new offences being introduced which you may see as being returned are noted below.
Drug Offences
Code: DG10
Offence: Driving or attempting to drive with drug level above the specified limit
Penalty points: 3 to 11
Code: DG60
Offence: Causing death by careless driving with drug level above the limit
Penalty points: 3 to 11
The above codes must stay on a driving licence for 11 years from the date of the conviction.
Code: DG40
Offence: In charge of a vehicle while drug level above specified limit
Penalty points: 10
The above code must stay on a driving licence for 4 years from the date of the offence or 4 years from date of conviction where a disqualification is imposed.
